Global Hindu Heritage Foundation strongly condemns the statement made by B R Gavai, the Chief Justice of the Supreme Court, that hurt the sentiments of Hindus across the globe. What is the statement that hurts the sentiments and feelings of Hindus?  It is unworthy of the position of Chief Justice of the land.
Rakesh Dalal filed a petition seeking the Supreme Court’s directive for the replacement/ reconstruction/ rejuvenation of the idol of the Lord Vishnu and to install/ consecrate the same at the Javeri temple, Khajuraho, Chhatarpur District, Madhya Pradesh, in place of the headless 7-foot-long Idol of Lord Vishnu.” He also pointed out that repeated protests, memoranda, and campaigns over decades had yielded no response.
Chief Justice of India tells a petitioner, “Go and ask the deity itself to do something now. You say you are a staunch devotee of Lord Vishnu. So go and pray now.”
Further, he also made a statement to the effect that, “This is purely Publicity interest litigation.”
He also noted that such matters fell under the jurisdiction of the Archaeological Survey of India (ASI), adding, “It’s an archaeological find, whether the ASI would permit such a thing to be done or not… there are various issues …. “In the meantime, if you are not averse to Shaivism, you can go and worship there… there is a very big linga of Shiva, one of the biggest in Khajuraho.”
It is not a part of a judicial record, and it is an oral observation made during the proceeding regarding the petition seeking direction for the construction and reinstallation of a dilapidated Lord Vishnu image in the Khajuraho Temple complex.
The statement by the Chief Justice is unnecessary, inappropriate, unwarranted, insensitive, disrespectful, and insulting.  It feels like he is making a mockery of the Hindu faith. It is unbecoming of a Supreme Court Judge. You must follow and respect the Constitution and show respect to Hindus who adhere to it. As an impartial judge, you could have asked the petition to approach ASI.
Rakesh Dalal approached the Supreme Court after exhausting all his other options. Why did you say that the petitioner should approach ASI when, in fact, it failed to take action? GHHF believes that your judgment should have been directing ASI to take immediate action. You failed in your responsibility because of either your hatred toward Hindu Gods or your intent to hurt the sentiments of Hindus.
The Constitution of India gives the privilege of professing and practicing one’s own faith.
*    Article 25 of the Constitution guarantees the right to freely profess, practice, and propagate religion.
•    Article 26 gives religious denominations the right to manage their own affairs in matters of religion.
•    Article 49 places a duty on the State to protect monuments of national importance.
So, when a devotee approaches the highest court to restore a beheaded idol, it is not just an emotional plea — it is a constitutional one.
If the judge has a negative opinion of Hindus, he has the power not to entertain the petition. Or he could have assigned the case to another judge.
Apologize
He should immediately address this matter and do the following:
1)    Withdraw the statements and apologize.
2)    Apologize publicly in an open public forum
Impeach
The Parliament of India should impeach for a reckless statement insulting the sentiments of Hindus. Judges with biased opinions should not be occupying the highest Court in the land. If judges like him do not have respect for the very social fabric of the country, they should not be occupying the highest court.
Your action, Sir!
•    Your statement undermines and corrodes the Hindu sentiments.
•    It reveals the inherent bias and lack of remorse on the part of the legal system
•    It is detrimental to the social fabric of society.
•    It is abusive of the culture and civilization that allowed you to become a Judge.
In conclusion, the Global Hindu Heritage Foundation requests that you withdraw your statement and apologize to Hindus.  You also have a constitutional obligation to resign from your post if you possess a certain level of morality, ethics, and righteousness.
Otherwise, we will request the Speaker of Parliament to take appropriate action to impeach the Chief Justice as per the Constitution
