[GHHF] Letter sent to the Chief Justice of the Supreme Court to take Suo moto action against hate Speech made by Udayanidhi Stalin by Assam Hindu Advocates Forum; Finally SC

Global Hindu Heritage Foundation demanded Udayanidhi Stalin be arrested immediately by the TN State government for his inflammatory statements deliberately and intentionally insulting the adherents of Hindu faith. His public statement hurts the sentiments of Hindus, disturbing the public tranquility, causing fear and feeling of insecurity among followers of Sanatana Dharma. GHHF strongly condemn the derogatory & bigoted statement to "Eradicate Santana Dharma" issued by Udhanyanidhi Stalin, son of Chief Minister M K Stalin in Tamil Nadu, India.
GHHF is astonished at the insensibility Udhanyanidhi Stalin who irresponsibly charged that "Sanatana Dharma is like mosquitoes, dengue and malaria that has to be eradicated."
We, concerned citizens, demand the immediate arrest of Udhanyanidhi Stalin for his bigoted behavior and divisive actions. It is imperative that we hold public figures accountable for their words and actions, especially when they promote hatred and discrimination.

Sri Samrat Dutt and other lawyers formed “Hindu Advocates Forum” more than a year ago and submitted letters challenging the issues that hurt the sentiments of Hindus.  Following is the letter written by them.

The Supreme Court on Wednesday tagged a petition seeking the registration of a first information report (FIR) against Tamil Nadu Minister and DMK lead Udhayanidhi Stalin over his controversial remarks about 'Sanatana Dharma', with another plea in which the court issued notice last week.

It is our painful duty to inform you that a recent development has caused much anguish in the hearts and minds of common citizens of this country, specially those who believe in Sanatan Dharma. Recently Udayanidhi Stalin the Minister of Sports and Youth Affairs in the Tamilnadu Govt. speaking at a conference in Chennai railed against Sanatan Dharma, equating it with dengu, malaria, fever, and corona. He added that Sanatan Dharma should not be merely opposed but eradicated.

In this respect we would lie to state that In the case of Writ Petition No. (Civil) 940/2022 in Shaheen Abdulla vs Union of India and others the Supreme Court specifically and categorically stated that State Police must take action Suo motu against hate speech. The Order was issued by a bench of Justice KM Joseph and BV Navaratnam. The Court issued a warning that late filing of cases would be considered contempt of Court. The Bench further said “We only care about the Constitution and laws of the Country. For the “larger public good” and to ensure the “rule of law” is established.

It is very unfortunate that Government of Tamilnadus action run in the face of Supreme Court judgment in the case of in Shaheen Abdulla vs Union of India and Aswini Kumar Upadhyay vs Union of India (Writ Pet No 943/2023) where in SC has directed that State Government should take Suo moto action against any hate speech crime without waiting for any complaint.

Therefore, since the State Government has refused to take action and acted in contempt of the Courts orders and gravely undermined or rather make a mockery of the rule of law, we urge the Hon’ble Supreme Court of India to take Suo moto notice contempt, ensuring accountability for the inaction of the State Government of Tamilnadu.

We sincerely hope for the thoughtful consideration of our plea and implore immediate measures to ensure justice and rule of Law to prevail.
