Global Hindu Heritage Foundation (GHHF) is in full support of Dr. Subramnian Swamy’s efforts to create harmony, peace, tranquility, peaceful co-existence, tolerance, respect for other religions, respect for motherland, respect for heritage, pride of being the children of Bharatmata, and respect for Vandemataram are appreciated, lauded and highly respected.  His seminal, thought provoking, intelligent, analytical, rational and superb article entitled “How to Wipe Out Islamic Terrorism?" is a peaceful solutions to a country that is being attacked by Islamic terrorists. Day in and day out, Bharatmata is being terrorized, strangled, smothered, suffocated, tormented, besieged by these Islamic terrorists at the dismay of the overwhelming majority of the people, who do not have any religious and missionary motive to dominate the country at any cost.

What is the solution Dr Swamy suggested to reduce the terrorism and live peacefully?

He suggested that Hindus “need a collective mindset as Hindus to stand against the Islamic terrorist.....If any Muslim acknowledges his or her Hindu legacy, then we Hindus can accept him or her as a part of the Brihad Hindu Samaj (greater Hindu society) which is Hindustan…. Others, who refuse to acknowledge this, or those foreigners who become Indian citizens by registration, can remain in India but should not have voting rights (which means they cannot be elected representatives)."

This article “angered,” “dismayed,” and “shocked” some sections of Hindustan for their own selfish reasons.  UPA government officials, many Muslims, secularists, atheists, communists, media and some Hindus who have become strange bedfellows of the current government for their unsatiated appetite to amass wealth, have decided to criticize the article by saying that it created enmity between the communities.  Harvard University students, some of their parents, some faculty and staff who should know more about freedom of speech, to their utter shame and disgrace, started their Petition drive requesting the University to terminate the teaching contract of Dr. Subramanian Swamy.

In response to the Harvard University student’s petition, University officials issued a statement upholding Dr. Swamy’s the freedom of speech and his right to express his views. Few days ago  William R. Dingee of The Harvard Crimson observed that “While Harvard stands by a professor's right to free speech, India is not quite as tolerant of Harvard-educated economist Subramanian Swamy.”

CASE Filed against Dr. Swamy; Delhi Police files FIR

In August the National Commission for Minorities (NCM) decided to file a case against Swamy for his remarks in the article. A complaint was filed by Asghar Khan against Swamy in this regard at Delhi Police Station. The Crime Branch registered on August 27, 2011 an FIR against Dr. under Sections 153-A (promoting enmity between different groups on grounds of religion … and doing acts prejudicial to maintenance of harmony), Section 153-B (imputations, assertions prejudicial to national integration), 295-A (deliberate and malicious acts intended to outrage religious feelings of any class by insulting its religion or religious beliefs) and 505 (statements conducing to public mischief).

On October 4, Dr. Swamy demanded “that the Prime Minister Dr. Manmohan Singh intervene and ask the Delhi Police to withdraw the stupid and vapid FIR registered by the Crime Branch for my DNA article of July 16,2011 on " How to Wipe Out Islamic Terrorism". This FIR has made India a laughing stock in the democratic nations of the world, while convincing patriotic Indians that it is motivated by the fear of my relentless investigations into the 2G Spectrum Scam, which investigations is to lead to making persons at the top of Congress Party culpable.

The FIR has been registered 2 1/2 months after my alleged inflammatory article was published in the Mumbai daily, The DNA. Since then 3 Police Stations have declined to register the FIR since no offence could be discerned. Hence the Crime Branch's act is obviously a command performance that has lowered the reputation of the government.”

Of course, minority appeasement, Muslim votes, slavish attitude to Sonia Gandhi, mindless desire to squash 2G scam to protect all the political cronies, and senseless desire to complete the five year term, gratuitous craving to promote Rahul Gandhi’s image, the Prime Minister neither respond to Dr. Swamy’s request nor withdrew the case.

Delhi Police Violated the Court ruling

On December 7, 2010 Delhi High Court ruled that Delhi Police should upload all First Information Reports (FIRs) registered in the city onto its website within 24 hours of filing. The police are required to implement the order from February 1, 2011.

Division Bench comprising Chief Justice Dipak Misra and Justice Manmohan decreed that "Fair and impartial investigation is a facet of Article 21 of the Constitution and presumption as regards the innocence of an accused is a right. Therefore, a person booked under criminal law has a right to know the nature of allegations so that he can take necessary steps to safeguard his liberty."

The Delhi Police registered this FIR based on a complaint received from Central Minorities Commission on 27th August 2011 and as per ruling of the Delhi High Court, Police department should have published or posted this FIR on the 28th of August 2011 itself. Their deliberate failure to treat the Orders of the Delhi High Court deserves appropriate punishment under the Law.

On October 8, Dr. Swamy, who knew the Delhi Court order fully well, threatened the Crime Branch of the Delhi Police that he would move the Delhi High Court or the Supreme Court pleading that the Delhi Police are guilty of gross contempt of the Delhi High Court for their failure to post a copy of the FIR against Dr. Swamy on Police Website within 24 hours of its registration on 27^th August 2011.

On Sunday (October 9) morning the Delhi Police finally handed over a Copy of the FIR to Dr. Subramanian Swamy, who said:  “HAPPY TO SAY THAT THE POLICE HAVE COMPLIED WITH MY ULTIMATUM AND SUPPLIED ME A COPY OF THE FIR TODAY. IT WAS REGISTERED ON A COMPLAINT OF THE MINORITY COMMISSION ON AUGUST 27th! WHAT WERE THEY DOING ALL THIS TIME FLOUTING THE 24 HOUR RULE OF THE DELHI HIGH COURT ORDER? GROSS CONTEMPT.”

Issue FIR against Certain Verses in Quran and Bible using CPC (95) and IPC (153 & 295)

According to Criminal Penal Code (Cr.PC) and Indian Penal Code (IPC), Indian government has the responsibility to ensure that any word spoken or written would not promote enmity between the communities.Brief summary of these sections are listed:

Cr. P. C 95: If any newspaper, book or any document that contains any matter which is punishable under section 124A or section 153A or section 153B or section 292 or section 293 or section 295A of the Indian Penal Code (45 of 1860), the State Government may, by notification, stating the grounds of its opinion, declare every copy of the issue of the newspaper containing such matter, and every copy of such book or other document to be forfeited to Government, and thereupon any police officer may seize the same wherever found in India and any Magistrate may by warrant authorize any police officer not below the rank of sub-inspector to enter upon and search for the same in any premises where any copy of such issue or any such book or other document may be or may be reasonably suspected to be.

What the IPC says about the matter that is punishable?

I.P.C. - Sec. 153A: “Whoever by words, either spoken or written or by visible representations, or otherwise, promotes or attempts to promote feelings of enmity or hatred between different classes of Her Majesty’s subjects, shall be punished with imprisonment which may extend to two years, or with fine or with both.”

I.P.C. - Section 295: “Whoever destroys, damages or defiles any place of worship, or any object held sacred by any class of persons with the intention of thereby insulting the religion of any class of persons or with the knowledge that any class of persons is likely to consider such destruction, damage or defilement as an insult to their religion, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”

I.P.C. Section 295A: “Whoever, with deliberate and malicious intention of outraging the religious feelings of any class of His Majesty’s subjects, by words, either spoken or written, or by visible representations insults or attempts to insult the religion or the religious beliefs of that class, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”

Would the Government Issue FIR for each of these verses in Quran?

“The Muslim conquests, down to the 16th century, were for the Hindus a pure struggle of life and death. Entire cities were burnt down and the populations massacred, with hundreds of thousands killed in every campaign, and similar numbers deported as slaves. Every new invader made (often literally) his hills of Hindus skulls. As a contribution to research on the quantity of the Islamic crimes against humanity, we may mention that the Indian (subcontinent) population decreased by 80 million between 1000 (conquest of Afghanistan) and 1525 (end of Delhi Sultanate)” --- Koenraad Elst.

Following are the selected verses in Quran contains offend the sentiments of Hindus, their worship practices, and their numerous gods because they are considered kafirs (non-believers). These verses create enmity between the religions, create disharmony, create poisonous climate for the destruction of Hind images, belittle the belief system, and encourage killing of non-believers (Hindus). Hindus believe in peaceful coexistence while the Quran believes in total domination with no rights for non-believers.

Idol worshippers

[31:13] Recall that Luqmaan said to his son, as he enlightened him, "O my son, do not set up any idols beside GOD; idolatry is a gross injustice."

[12:106] The majority of those who believe in GOD do not do so without committing idol worship.

[4:48] GOD does not forgive idolatry, but He forgives lesser offenses for whomever He wills. Anyone who sets up idols beside GOD, has forged a horrendous offense.

[4:116] GOD does not forgive idol worship (if maintained until death),and He forgives lesser offenses for whomever He wills. Anyone who idolizes any idol beside GOD has strayed far astray.

[39:65] It has been revealed to you, and to those before you that if you ever commit idol worship, all your works will be nullified, and you will be with the losers.

[72:18] The places of worship belong to GOD; do not call on anyone else beside GOD.

Idolaters are unclean just because they are idolater
9.28: O you who believe! The idolaters are nothing but unclean, so they shall not approach the Sacred Mosque after this year; and if you fear poverty then Allah will enrich you out of His grace if He pleases; surely Allah is Knowing Wise.

Forcing non-believers to pay tax
9.29: Fight those who do not believe in Allah, nor in the latter day, nor do they prohibit what Allah and His Apostle have prohibited, nor follow the religion of truth, out of those who have been given the Book, until they pay the tax in acknowledgment of superiority and they are in a state of subjection.

 2.62, 5.69 : All except Muslims / Jews/Christians / Sabians will go to hell
Surely those who believe, and those who are Jews, and the Christians, and the Sabians, whoever believes in Allah and the Last day and does good, they shall have their reward from their Lord, and there is no fear for them, nor shall they grieve.

Smite the neck and cut fingertips of unbelievers
8.12: When your Lord revealed to the angels: I am with you, therefore make firm those who believe. I will cast terror into the hearts of those who disbelieve. Therefore strike off their heads and strike off every fingertip of them.

Smite the neck of unbelievers
47.4: So when you meet in battle those who disbelieve, then smite the necks until when you have overcome them, then make (them) prisoners, and afterwards either set them free as a favor or let them ransom (themselves) until the war terminates. That (shall be so); and if Allah had pleased He would certainly have exacted what is due from them, but that He may try some of you by means of others; and (as for) those who are slain in the way of Allah, He will by no means allow their deeds to perish.

Severe Punishment for atheists
10.4: To Him is your return, of all (of you); the promise of Allah (made) in truth; surely He begins the creation in the first instance, then He reproduces it, that He may with justice recompense those who believe and do good; and (as for) those who disbelieve, they shall have a drink of hot water and painful punishment because they disbelieved.

5.10: And (as for) those who disbelieve and reject our communications, these are the companions of the name.

5.86: And (as for) those who disbelieve and reject our communications, these are the companions of the flame.

Severe Punishment for non-believers
22.19: These are two adversaries who dispute about their Lord; then (as to) those who disbelieve, for them are cut out garments of fire, boiling water shall be poured over their heads.

22.20: With it shall be melted what is in their bellies and (their) skins as well.

22.21: And for them are whips of iron.

22.22: Whenever they will desire to go forth from it, from grief, they shall be turned back into it, and taste the chastisement of burning.

Severe Punishment for non-believers
72.23 : (It is) only a delivering (of communications) from Allah and His messages; and whoever disobeys Allah and His Apostle surely he shall have the fire of hell to abide therein for a long time.

98.6 : Surely those who disbelieve from among the followers of the Book and the polytheists shall be in the fire of hell, abiding therein; they are the worst of men.

Punishing non-believers of Hereafter
17.10: And that (as for) those who do not believe in the hereafter, we have prepared for them a painful chastisement.

Punishing for rejecting faith
3.91 : Surely, those who disbelieve and die while they are unbelievers, the earth full of gold shall not be accepted from one of them, though he should offer to ransom himself with it, these it is who shall have a painful chastisement, and they shall have no helpers.

Unbelievers go to hell
4.140 : And indeed He has revealed to you in the Book that when you hear Allah's communications disbelieved in and mocked at do not sit with them until they enter into some other discourse; surely then you would be like them; surely Allah will gather together the hypocrites and the unbelievers all in hell.

7.36: And (as for) those who reject our communications and turn away from them haughtily -- these are the inmates of the fire they shall abide in it.

Would the Government Issue FIR for Bible Verses?

2 Kings 11:18 All the people of the land went to the temple of Baal and tore it down. They smashed the altars and idols to pieces and killed Mattan the priest of Baal in front of the altars. Then Jehoiada the priest posted guards at the temple of the LORD.

Psalm 16:4 The sorrows of those will increase who run after other gods. I will not pour out their libations of blood or take up their names on my lips.

Isaiah 27:9 By this, then, will Jacob's guilt be atoned for, and this will be the full fruitage of the removal of his sin: When he makes all the altar stones to be like chalk stones crushed to pieces, no Asherah poles or incense altars will be left standing.

Zechariah 13:2 "On that day, I will banish the names of the idols from the land, and they will be remembered no more," declares the LORD Almighty. "I will remove both the prophets and the spirit of impurity from the land.

Pay Jizya ax or convert to Islam

Where is FIR for the Two Municipalities that threatened Jizya Tax or conversion in Tamil Nadu?

In 2006, Muslims were elected to the Thondi and Rasathipuram Municipalities of Ramanathapuram and Vellore districts respectively.  Within months the Muslim dominated Municipalities terminated denied civic amenities, funds for schools, garbage clearing etc., and sent notices in Urdu. When the Hindus approached the Municipalities, they were bluntly told to either pay Jizya tax or get converted to Islam. The Muslim dominated and ruled municipalities trying to convert these areas into mini ‘Darul Islams’ in a Hindustan of 83% Hindus! Dr. Swamy had to go to High Court and get a stay order and squash the municipalities’ decision.

Where is the government and why it did not utilize article 153A and take legal action for creating enmity between the communities?

Fatwa Issues by Muslims – Would the Government Issue FIR on Terrorist organizations?

         When would the Indian Government declare Fatwa as anti-secular and anti-human? Fatwa is creating enmity between the communities and targeting mainly Hindus to convert, impose Jizya tax, create Darul Islam, destroy property, terrorize community or kill them.

On July 13, 2011 a group known as Darul Ulloom Deobad issued Fatwa in Nagpur on Hindus living in Muslim-majority areas demanding that they should either             accept Islam or pay 10 percent of their income as ‘Jizya.’ If they do not obey the Fatwa, Hindus should be prepared to fight.  It is further stated that, “This country does not belong to Hindus now and it never belonged to Hindus. This country was ruled by Muslims for so many years … that the areas where Muslims are in majority, the governance should be by Muslims as per ‘Shariat’ law.

Where is the government to issue FIR based on I P C 153 since it is hurting the sentiments of Hindus and threatening to impose unlawful governance over Hindus?

Hindus have to wake up and Fight for their Survival.

         Hindus have to wake up to the reality that their survival is in danger. Their values, their believes, their culture, their scriptures, their morals, their philosophy of peaceful coexistence, their tolerance, and their inclusiveness are at stake. The Congress party, Communists, Muslims, Christians, secularists, and atheists is waging a fierce, vicious, and violent battle against Hindus. They have to recognize that the dark clouds are hovering over the Hindus and they may be washed out with torrential rain of terror, bombs, lootings, bombings and killings. They have to face boldly the exclusive mind-set of Muslims and Christians who are determined to convert Hindus in to their fold by whatever means available to them – deception, denigration, allurements, appeasements, bribes, bombings, forceful conversions, and destruction.

Let us remember the words of Anne Besant who worked tirelessly to advocate the preservation of Santana Dharma. Bharat must be protected, Hindu roots must be nourished and it should remain as the center of the Vedic culture.  “After a study of some forty years and more of the great religions of the world, I find none so perfect, none so scientific, none so philosophic, and none so spiritual as the great religion known by the name of Hinduism. The more you know it, the more you will love it; the more you try to understand it, the more deeply you will value it. Make no mistake; without Hinduism, India has no future. Hinduism is the soil into which India’s roots are struck, and torn of that she will inevitably wither, as a tree torn out from its place. Many are the religions and many are the races flourishing in India, but none of them stretches back into the far dawn of her past, nor are they necessary for her endurance as a nation. Everyone might pass away as they came and India would still remain. But let Hinduism vanish and what is she? A geographical expression of the past, a dim memory of a perished glory, her literature, her art, her monuments, all have Hindudom written across them. And if Hindus do not maintain Hinduism, who shall save it? If India’s own children do not cling to her faith, who shall guard it? India alone can save India, and India and Hinduism are one.”
